so this case has some merrit, however, the very core of this case is based on the employment being annually renewable. which means that the petitioner had to take periodic active action to be employed with the university employer... thats where the argument broke down for the petitioner... further, it is VERY GOOD to know that USCIS actually made an attempt to consider this emloyment for I-140 approval. it is good to know that they deliberated and then decided to reject instead of summarily rejecting on prima facie facts. one more very good thing to know (and avoid for ourselves) is that the petitioner in this case represented himself (no lawyer). its possible that if there was a laywer involved, they could have brought up some more documentation or at least shown the light to the university's staff as far as requirements are concerned. further still: no talk was engaged into as far as ability to pay is concerned. FURTHER FURTHER still: this case is about I-140... and we are all talking primarily about I-485 and AC21 cases within....

All 140K GCs are available on Oct 1. However, dates were not current in 2005 and 2006. I think that current dates do not depend on available GCs.
Looks like current dates depend on # submitted AOS's. USCIS is saying that on Jul 2 it has submitted AOS's that exhaust submitted AOS quota.

EAD was about to expire before 90 days, so I took an infopass apt. The person that heard my case (soolemaga) was a d**k. Rude and impossible to communicate with. Anyway, he sent an email to someone at TSC after much cajoling and I get a call the same day from some nice lady from TSC. She says that my application for EAD is approved and I should get my card in 2 weeks. 2 days after I get the call from TSC, I get an email that card production is ordered!
I had initially called USCIS support with an expediate request citing Severe financial loss and I got a letter back that they are very strict processing expediate requests as they get a lot of such requests. So they had asked me to wait.
Hope this information helps someone!

USCIS are doing internal transfer from more than a year(140 & 485). They are processing 140 and 485 at both the centers and requesting the application at NE only. It seems now you noticed.
well they have started allowing for direct filing to each of these centers from July 30th. It's going to be another pre-PERM situation when place like nevada used to process labor in 3 months whereas NY was taking 2 years.

I read and hear the same thing over and over again, NO SAVINGS,
It is also true for me, NO SAVINGS, We all earn a better salary from others since we are high level professionals, born from a indian family. Where are we wrong.
my first 3 years used to save money, from last 3 years i have no savings. better lifestyle than india. Canadian green card backed up. paid paid money to immigration lawyers for US and canada. , NO US education. Helped friends and relatives financially. Setup a business in india, just doing Okay.
Now i am thinking is it worth staying in US away from parents.
1. Good health (which we often take for granted)

2. US born kids (at least they are citizens, if that's important to you)
Not married no kids
3. US education (a different experience for sure)
No us education
4. Good savings (all said and done, your bank balance is very important no matter where you stay in the world)
No savings no big salary
5. Good work experience (this is transferable and more or less ensures a decent future)
Yeah just started career
6. Loving/caring family/friends (who will always love you the same and couldn't care less about GC or citizenship)

Even after 180 days, your employer put a withdrawal request with proof of insufficient financial strength to pay you from the period start (within 180 days ) till the withdrawal request date then what will you do? Now it is clearly "un approvable" during "even within 180 days" . Now 180 days passed already? - yes. I-140 is already approved? - No, Employer filed withdrawal ?- yes? Employer shows underlying reason of insufficient finance capacity within 180 days - yes .. Then case closed - Denial - Next.

I am just trying to see if NSC could go past the I-485 received on 06/01/2007. Many folks whose application was received the first day got receipt and receipt#. Is there anyone who applied later and got the receipt or receipt#.

You have got all things reversed.
Most of the H1B guys have families, they have kids that they need to support, most of them are single income families because of green card delays and we need money to visit our home countries atleast once every 3 years when each ticket cost 1.5K $ and this employer keeps 4k which is not his, so who is insensitive and whose practice is best?.
Most consulting companies run by desis who do not want the company to grow big. They want to keep it small by hiring a handful of H1B guys and keep sc****ng them..
It has to be a win-win situation for both, especially when the employee finds his own project and has been doing a bit for the company, this needs to be reciprocated. If someone opens a company he cannot expect somebody to be working for him for-ever. If the employee wants to leave him after a couple of years, making his exit difficult is unprofessional, unethical and downright cheap.
